Execution and bankruptcy law

You have outstanding claims which are not being paid? We will carry out the collection proceedings on your behalf and advise you about the debt enforcement proceedings. Should it not be possible to find an out-of-court solution with the debtor we will represent you before court.


Conciliation proceedings

As a rule it is mandatory to conduct conciliation proceedings in Liechtenstein before bringing a case before a court. The conciliation takes place at the conciliation department of the respective municipal authority of the defendant. If the conciliation proceedings fail the conciliation department will issue an official report [Leitschein], with which we can subsequently file an action on your behalf at the Regional Court [Landgericht].


Payment order and dunning procedure

In order to collect a claim for money the Regional Court will issue a conditional payment order following an application from the creditor. There will be no hearing in this case.
If no objection is filed in time against the payment order this will become final and absolute and can be enforced in the execution proceedings.

Execution

After the judgement or the payment order has become final and absolute the award can be enforced in court.
We will be pleased to advise you accordingly and will file all necessary applications for the execution on your behalf.


Bankruptcy

Bankruptcy proceedings will be opened following the application from a creditor if the debtor is no longer in the position to settle the claims.

We will also register the claim in the bankruptcy on your behalf and represent you in the proceedings.
